more. good morning. reporter: good morning, michelle and frank. cbs news sources have learned actually that e -o t g that interrogation that he had a role in the bombings here at the marathon. he has a bail hearing and probable cause hearing on may 30th. 19-year-old johar tsarnaev's hospital room became a makeshift courtroom monday. a federal judge arraigned the terror suspect and announced he is being charged with using a weapon of mass destruction during boston marathon bombings last week. it killed three and injured 180. if convicted, he could face the death penalty. prosecutors believe he and his 26-year-old brother tamerlan placed two pressure cooker bombs on boylston street around the marathon finish line. tamerlan died friday in a shootout with police. johar is being treated for gunshot wounds here at beth israel hospital but despite being listed in serious condition, the judge said, i find that the death of is alert, mentally competent and lucid.

cbs news learned interrogators questioned johar in his ital be told them that he and his brother acted alone in order to carry out the marathon bombings. our sources say the tsarnaev brothers read jihadist websites but were not reportedly part of a terrorist group. because johar is a united states citizen the justice department is trying him as a civilian, not an enemy combatant. >> since 9/11, we have used the federal court system to convict and jail hundreds of terrorists. >> reporter: late monday night federal investigators swarmed an area behind a cambridge business where the father used to work on cars. officials placed a tarp over the scene to keep the search private. but they were filmed carrying out a box. the m.i.t. police officer who was murdered on friday, ambushed and murdered on friday, will be laid to rest today later on in a funeral service. that service will be private. there will be a public memorial service tomorrow. and vice president joe biden is expectbe at that public

service. reporting live in boston, back to you. >> so sad, edward. we've seen a lot of the victims being honored this week. let's talk about the teenaged suspect. do we know anything more about his condition? >> reporter: yeah. at this point heis still in serious condition and as you said in the beginning, he was not able to speak. he was communicating through nodding. he was also writing down his answers for the judge. at this point, he is recovering. but he is still in serious condition. >> and edward, how about boylston street? i understand the city finally got that back. they opened it up, right? >> reporter: yeah. there was a five-step process. it did open this morning. it's a major street here in boston and traffic was snarled, obviously, people needed to recover and see the memorial and honor the victims of the bombing. but again, this morning that street is now open. >> thank you, edward lawrence in boston. also from boston, a surprise visit to the hospital

room of 11-year-old aaron hern from martinez. her is recovering from injuries suffered in last week's bombings. ty waller, brandon moss and josh reddick of the as stopped by to see how he is doing. ♪[ music ] and aaron's classmates at martinez junior high wanted to make sure he knows they have his back. they sent him this get well video on youtube with signs there. his math teacher took her camera room to room to show kids offering signs of encouragement. >> pretty nice. >> that's a "cool school." >> really it is. >> nice. 5:04. officials on both side of the border do not think there is a connection between two terrorism suspects up in canada and the boston bombings. authorities say two men were scheming to derail a passenger train in the toronto area. the suspects are foreign nationals who do live in canada. officials say they were in the planning phase and were getting outside help.

>> the individuals were receiving support from al qaeda elements located in iran. >> two suspects have been under surveillance for more than a year now. they apparently didn't get financial help from al qaeda. this plot was not linked to the boston marathon bombings. in the wake of the boston bombings, san francisco is looking into a new way to secure its own streets. police chief greg suhr is thinking about setting up cameras along market street to monitor big events like parades that attract millions of people. >> i'm not talking about monitoring this day to day. i'm talking about during the events when there's 100,000 people up and down market street. >> cameras on market are not a new idea. there are plenty of private security cameras already up along the street. but police only look at them after the fact. the police chief will take his idea to the board of supervisors. how about the weather? it's never been so hot this time of year. temperature records fell all over the bay area yesterday

back to you guys. >> thank you. more fire at soon be closing in contra costa county. several jobs are on the line, as well. kpix 5 reporter cate caugiran is live in martinez this morning with more on the proposed cuts. >> reporter: we're live at what used to be station 12 in martinez and is now an empty building. this was one of the four stations shut down this year as part of budget cuts. the new budget is proposing two more station closures in the upcoming fiscal year. as for staffing, although 365 are recommended, the budget only calls for 293. firefighters are outraged over the proposed plan. they say more cuts are critical to the safety of the area. for example, this fire in september destroyed two homes in concord. firefighters said these fires response times were slower. and the president of the united professional firefighters of

contra costa county has already come out with a statement saying the plan is unacceptable and he says enough is enough. reporting live in martinez, cate caugiran, kpix 5. >> all right, cate, thank you. the contra costa county board of supervisors will be reviewing the proposed budget today at 9:00. a groundbreaking happens later this morning in burlingame for the first new public elementary school there in a half century. hoover elementary has not held students in more than 30 years. some neighbors want it to stay closed. they filed a lawsuit to stop the renovation project citing concerns about increased traffic on narrow roads. it is 5:09 now. a key step today in the court ordered reform of the oakland police department. a compliance director is expected to present his proposed work plan and budget to city officials later today. thomas frazier a former police chief in baltimore was appointed by a federal judge just last month. he has broad power to set an

action plan and to fire or demote top police officials. to the south now, a positive development for police in san jose. a new report finds that citizen complaints about the conduct of officers decreased last year by 7%. the number of complaints that resulted in officer discipline after internal review was also down. it went from 10% of cases in 2011 to just 3% in 2012. the report comes from a retired judge, who is now san jose's independent police auditor. a newspaper investigation finds that the state of nevada has been dumping psychiatric patients out of state. the "sacramento bee" finds as many as 1500 poor and mentally disabled patients got one way bus tickets from the state-run rawson neil hospital in las vegas. now san francisco's city attorney is launching his own investigation. >> patient dumping in itself is reprehensible and it's illegale

police this morning at the home on international boulevard. tim, what can you tell us? >> reporter: michelle, this is an area of dense housing, not terribly far from the coliseum near 66th and international boulevard. police have surgeon rounded a building searching for -- have surrounded abufo a man linked to a shooting at 10:00 last night at 90th and cherry about five or 10 minutes from here. police say a man was shot in the leg by a male acquaintance nonlife-threatening injury. the man called police and told them who shot him. police came to this area. the man's car is apparently at this apartment building. so for hours, they have surrounded this building trying to talk the man out. whether they're sure that he is inside really is not clear although just within the last 10 or 15 minutes i heard some flash-bang devices go often that will be a prelude to an end so oakland s.w.a.t. is here trying to end this thing soon and to end this

safely. michelle? >> tim, this is frank. have they had any conversations with this guy throughout the night? this i have been there since 10:30 or so -- they've been there since 10:30 or so. >> reporter: as far as i know -- and i just e with an oakland police officer just minutes ago, hesays there have been no nvons. so this could, frank, just be one of those situations where they surround a home that turns out to be empty. but they are trying to bring this to an end safely. >> we're watching video now of all the police activities there. are they telling neighbors to stay in their homes. >> reporter: you know, i believe that they have not made any mandatory evacuations although someone who apparently was near -- and again, this is very dense housing. not much space in between that's buildings. apparently, at least one resident here decided that they would get out. other than that, people are mostly still asleep. the parking lot full of cars although of course some people

companies in the s&p will report their results this week alone. the reports have been pretty good so far. on wall street the dow reversed an early slide yesterday and gained 19 points. the nasdaq climbed 27. stock indices have more than doubled since the march 2009 bottom. but many investors still a little spooked by the markets. here to explain why is jill schlesinger, cbs news senior business analyst. >> reporter: good morning. >> ordinary investors might pile into stocks. tell us what's going on. >> reporter: well, it's so wild because the financial crisis and the subsequent 55% drop in stock indexes clearly have lot of a lasting impression on investors. according to bankrate.com's financial security index, a whopping 76% of respondents say they are just saying, no to

stocks. that's a huge number. economists call this recency bias. we tend to use our resent experience as a guide for what's going to happen in the future. sohen stocks are soaring, we think markets are just going to keep on going up. but when the market plunges, we become convinced they will never rise again. >> well, so where is all the money? people are making money since 2009. are they hoarding it? is it in mattresses out there? where is it all? >> reporter: european mattresses with safes in them. [ laughter ] >> reporter: most of these folks are clinging to the perceived safety of bonds. according to the investment company institute, since the financial crisis began, stock mutual funds saw outflows 66% of the time. investors yanked out almost half a trillion dollars from their stock mutual funds. meanwhile, bond funds reported in flows 81% of the time. so, you know, adding stocks to bonds. here's a warning. bond prices can fluctuate.
